By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Description of Service

DumaGo is a tool that helps you create and manage marketplace listings. The Service:

  • Uses AI to generate listing titles, descriptions, and pricing suggestions
  • Allows you to post listings to connected marketplaces (eBay, TikTok Shop, Amazon, Etsy, Facebook Shops) through their APIs
  • Stores your photos and listing data temporarily

3. User Responsibilities

3.1 Ownership and Rights

You represent and warrant that:

  • You own or have the legal right to sell any items you list through our Service
  • You have the right to use any photos you upload
  • Your listings do not infringe on any third party's intellectual property rights

3.2 Listing Accuracy

You are solely responsible for:

  • The accuracy of all listing information (title, description, condition, price)
  • Ensuring your listings comply with each connected marketplace's policies and applicable laws
  • Verifying AI-generated content before posting

3.3 Prohibited Items

You agree NOT to use the Service to list:

  • Weapons, firearms, or ammunition
  • Illegal drugs or controlled substances
  • Counterfeit or stolen goods
  • Adult content or services
  • Items prohibited by any connected marketplace's policies
  • Any items illegal to sell in your jurisdiction

3.4 Marketplace Compliance

You acknowledge that:

  • You are bound by each connected marketplace's seller agreement and policies, including but not limited to: the eBay User Agreement, TikTok Shop Terms of Service, Amazon Services Business Solutions Agreement, Etsy Seller Policy, and Facebook Commerce Policies
  • Violations of marketplace policies may result in account suspension by the respective platform
  • We are not responsible for any marketplace's actions regarding your seller account

4. AI-Generated Content

4.1 Nature of AI Content

The Service uses artificial intelligence to generate listing content. You understand that:

  • AI-generated content may contain errors or inaccuracies
  • Suggestions for brands, models, or authenticity are AI predictions, not guarantees
  • You must review and verify all content before posting

4.2 Your Review Obligation

You agree to:

  • Review all AI-generated content before publishing
  • Correct any errors in titles, descriptions, or item specifics
  • Verify that condition descriptions accurately reflect the item
  • Remove any claims of authenticity unless you can verify them

5. Limitation of Liability

5.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF AI-GENERATED CONTENT, UNINTERRUPTED OR ERROR-FREE OPERATION, OR RESULTS FROM USING THE SERVICE.

5.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR: ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES; MARKETPLACE ACCOUNT SUSPENSIONS OR RESTRICTIONS; BUYER COMPLAINTS, RETURNS, OR DISPUTES; OR ANY DAMAGES EXCEEDING THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

5.3 Indemnification

You agree to indemnify and hold harmless DumaGo from any claims, damages, or expenses arising from your use of the Service, your listings or sales, your violation of these Terms, or your violation of any third party's rights.

6. Account and Access

6.1 Account Security

You are responsible for maintaining the security of your account credentials, all activity that occurs under your account, and notifying us immediately of any unauthorized access.

6.2 Termination

We may suspend or terminate your access to the Service for violations of these Terms, for suspicious or abusive activity, or at our discretion with or without notice.

6.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately, we may delete your data according to our retention policy, and active marketplace listings are not affected (managed directly by each respective platform).

7. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting a notice in the Service or sending an email to your registered address. Continued use of the Service after changes constitutes acceptance of the new Terms.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.

9. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through informal negotiation (30 days), followed by binding arbitration if necessary.
